These terms govern VISORY IA services contracted with the owner. They are intended for businesses, professionals and agencies. Where the customer qualifies as a consumer, they retain their applicable mandatory rights.
2. Requests and contracting
The form, demo and configurator do not charge a payment or formalise an order. Contracting requires a proposal identifying the client, plan, brands, markets, users, coverage, deliverables, measurement frequency, schedule, duration, payment method and total price including applicable taxes. The client must expressly accept that proposal and receives a copy on a durable medium. Add-ons are not activated without acceptance.
The specific terms define the engagement and may improve on these terms. No commercial text replaces the accepted scope. Each plan’s scope is specified before purchase.
3. Prices and options
Public starting prices are Monitor €99/month, Core €399/month and Deep €899/month. Custom starts at €1,500/month and requires a quotation. Public professional prices exclude taxes; the full amount payable is disclosed before acceptance.
| Duration | Monthly instalments | Full payment upfront | Commitment |
|---|---|---|---|
| Monthly | Base rate | Not applicable | One month; cancellable for the next renewal |
| Six-month | 5% discount on the base fee | 10% discount on the base fee | 6 full months |
| Annual | 10% discount on the base fee | 18% discount on the base fee | 12 full months |
The monthly price shown for a six-month or annual term is its monthly equivalent to facilitate comparison. If paid upfront, the full period is payable at the start. Monthly instalments spread the payment, but do not shorten the commitment.
Discounts apply to the base fee. Add-ons retain their monthly rate; units, duration and compatibility are specified in the proposal. Agency and Custom terms are specific to the engagement.
4. Cancellation, duration and renewal
The monthly option allows cancellation of the next renewal. If you request cancellation after a renewal payment has been taken and the audit for that period has not yet been generated, you may request a refund of that monthly fee and cancellation of the renewed period. If the audit has already been generated, the work for that period is considered completed: the monthly fee is not refunded for voluntary cancellation, and cancellation prevents the following month’s charge. The service remains available until the end of the paid period.
This commercial policy applies to monthly renewals. It does not turn instalment payments for a six-month or annual plan into a subscription without commitment, or limit applicable statutory rights concerning withdrawal, lack of conformity or breach.
Six-month and annual options carry commitments of six and twelve months respectively, whether paid upfront or in monthly instalments. They do not permit early cancellation at the client’s discretion: ceasing to use the service does not cancel fees for the contracted period. Non-renewal at the end of the commitment may be requested at any time. This does not limit withdrawal where legally applicable or remedies for breach by the provider.
The proposal identifies start and end dates, the payment schedule and any automatic renewal, including its notice period. No automatic renewal applies unless communicated and accepted. A new six- or twelve-month commitment requires accepted renewal terms.
To cancel or prevent renewal, email hello@visoryia.com identifying the client and service. You will receive confirmation of the effective date. Cancellation does not automatically erase data or refund periods properly provided.
5. Scope and delivery
VISOR analyses the evidence available in the datasets and dates defined for the engagement. The fee does not imply daily or unlimited measurements, or access to every platform. The update schedule is specified in the proposal.
For one brand and one market, the indicative first-audit delivery time is 2–3 business days from receipt of the necessary information and confirmation of the engagement. Multi-market, Deep and Custom projects have their own timelines. Any dependency affecting delivery is communicated to the client.
One-off audits, where offered, have a separate proposal specifying the measurement date, deliverables and one-off price. They do not include recurring monitoring or renew by default.
6. Changes, payments and issues
Additions, scope reductions and plan changes require an agreement specifying their effect on price, duration and deliverables. No additional charges are made without authorisation.
Payment methods and due dates appear in the proposal or invoice. In the event of non-payment, the issue is communicated and an opportunity to remedy it is provided before suspension. Suspension does not automatically erase information or extinguish an enforceable debt.
If a delivery does not meet the accepted scope, the client may report it for review and correction. Where the provider breaches the agreement, the applicable legal remedies and rights apply, including, where appropriate, refunds for services not provided. The client’s mandatory rights are not excluded.
7. Access, agencies and confidentiality
The client supplies sufficient and lawful information, designates authorised users and recipients, and protects their credentials. Each user accesses their assigned scope. The client must hold rights to supplied materials and avoid including unnecessary personal data.
For agency services, the proposal specifies white labelling, agency and client access, and agency-branded deliverables. Engagement details are not published as a case study without authorisation.
The parties keep non-public information received during the service confidential, except where authorised, legally required or lawfully public. Personal data processing is governed by the privacy policy and, where appropriate, a data processing agreement.
8. Deliverables and exit
The client retains their materials and receives professional usage rights for the contracted deliverables. An agency may share them with the client for whom they were prepared. The software, method and third-party elements retain their respective rights and licences.
Before the service ends, the client may download deliverables enabled in their plan or request them from the team. The proposal specifies any subsequent dashboard availability and retention periods. Cancellation does not grant perpetual access to the software. Statutory retention obligations and personal data rights remain in force.
9. Assessment limitations
AI platform answers and sources change. Results depend on the sample, date, market and available evidence, and may include limitations requiring interpretation. The service provides assessment and expert judgement; it does not guarantee mentions, positioning, sales or future results. These limitations do not exclude legal liability or the obligation to provide the agreed service.
10. Consumers and withdrawal
If you contract as a consumer and distance-contracting rules apply, you may withdraw within 14 calendar days from conclusion of the contract. You may do so by sending an unequivocal statement to the stated contact, identifying the service and contract date.
If you expressly request that the service begin during that period and subsequently withdraw, a proportionate charge for the service provided may be payable under applicable law. Loss of the right following full performance requires prior express consent and acknowledgement of that consequence; it is not presumed merely from contracting or receiving a report.
Indicative notification form: “To The Digital Brand Experience, S.L.: I hereby withdraw from the contract for service [identification], entered into on [date]. Customer name: [name]. Address/contact: [details]. Date: [date]. Signature, only if submitted on paper.”
11. Enquiries, legislation and versions
For support, billing or complaints: hello@visoryia.com. For legal and privacy matters: gestion@thedigitalbrandexperience.es. Spanish law applies, subject to mandatory rules and applicable jurisdiction, particularly consumer rights.
The accepted version is supplied with the proposal. A website update does not retroactively alter an existing contract without the relevant agreement or legal basis.
